WHEREAS:

(a) The Parties are lawfully married under Thai law.

(b) By mutual consent of both spouses, the Parties wish to divorce and record their agreements regarding property, debts, children (if any), and all related matters.

(c) The Parties intend to present this Divorce Settlement Agreement to the competent registrar (District Office/Amphur or other competent authority, as applicable) in support of divorce registration.

(d) Each Party confirms that they enter into this Agreement voluntarily, having had an opportunity to seek independent advice, and without fraud, coercion, or undue influence.

NOW, THEREFORE, in consideration of the mutual covenants herein, the Parties agree as follows:

บทนำ:

(ก) คู่สัญญาทั้งสองฝ่ายเป็นคู่สมรสโดยชอบด้วยกฎหมายตามกฎหมายไทย

(ข) โดยความสมัครใจของคู่สมรสทั้งสองฝ่าย คู่สัญญาตกลงหย่าโดยความยินยอม และประสงค์ให้มีข้อตกลงเกี่ยวกับทรัพย์สิน หนี้สิน บุตร (ถ้ามี) และเรื่องอื่นที่เกี่ยวข้อง

(ค) คู่สัญญาประสงค์ให้นำข้อตกลงฉบับนี้ไปยื่นต่อพนักงานทะเบียน ณ สำนักงานเขต/อำเภอ หรือหน่วยงานที่มีอำนาจตามกฎหมายแล้วแต่กรณี เพื่อใช้ประกอบการจดทะเบียนหย่า

(ง) คู่สัญญาแต่ละฝ่ายยืนยันว่าได้ทำข้อตกลงฉบับนี้โดยสมัครใจ ได้รับโอกาสในการขอคำปรึกษาโดยอิสระ และไม่มีการฉ้อฉล บังคับ ข่มขู่ หรือใช้อิทธิพลโดยมิชอบ

ดังนั้น คู่สัญญาจึงตกลงกันตามเงื่อนไขดังต่อไปนี้:

1.1 The Parties agree to divorce by mutual consent and to register the divorce in accordance with Thai law.

Registration method and place (select one or more as applicable):

☐ Register the divorce jointly at the same District Office/Amphur in Thailand.

☐ Register the divorce at different District Offices/Amphurs within Thailand.

☐ Register the divorce at a District Office/Amphur in Thailand, with one Party executing and/or legalizing required documents at a Thai Embassy or Consulate abroad for use in Thailand.

☐ One or both Parties shall execute and/or legalize divorce-related documents before a Thai Embassy or Consulate abroad to support the divorce registration in Thailand.

1.2 Acknowledgment and Submission to the Registrar
The Parties agree to submit this Agreement to the registrar at the relevant District Office/Amphur (or other competent authority, as applicable) in support of the divorce registration and intend this Agreement to form part of their mutual-consent divorce arrangements. The divorce shall be effective only upon registration in accordance with Thai law.

1.1 ทั้งสองฝ่ายตกลงหย่าโดยความยินยอม และจะดำเนินการจดทะเบียนหย่าตามกฎหมายไทย

วิธีและสถานที่จดทะเบียนหย่า (เลือกได้หนึ่งข้อหรือมากกว่าตามความเหมาะสม):

☐ จดทะเบียนหย่าร่วมกัน ณ สำนักงานเขต/อำเภอเดียวกันในประเทศไทย

☐ จดทะเบียนหย่าที่สำนักงานเขต/อำเภอในประเทศไทย โดยฝ่ายหนึ่งอาจดำเนินการลงนามและ/หรือรับรองเอกสารที่เกี่ยวข้อง ณ สถานเอกอัครราชทูตหรือสถานกงสุลไทยในต่างประเทศ เพื่อใช้ประกอบการจดทะเบียนหย่าในประเทศไทย

☐ ฝ่ายหนึ่งหรือทั้งสองฝ่ายดำเนินการลงนามและ/หรือรับรองเอกสารที่เกี่ยวข้องกับการหย่า ณ สถานเอกอัครราชทูตหรือสถานกงสุลไทยในต่างประเทศ เพื่อใช้ประกอบการจดทะเบียนหย่าในประเทศไทย

1.2 การรับทราบและการยื่นต่อพนักงานทะเบียน

2.2 Parental Authority (select one)
