สัญญาก่อนสมรสฉบับนี้ จัดทำขึ้นเมื่อวันที่ [กรอก “วันที่” เป็นเลขไทย] เดือน [กรอกชื่อเดือนภาษาไทย] พุทธศักราช ๒๕[กรอกเลขไทยสองหลักท้ายของปี] ณ [กรอกสถานที่ทำสัญญา] ประเทศไทย

ข้อเท็จจริงเบื้องต้น (Recitals)

(ก) การสมรส / Marriage Intention

คู่สัญญามีความประสงค์จะสมรสกันภายใต้กฎหมายแห่งราชอาณาจักรไทย และตกลงที่จะกำหนดสิทธิและหน้าที่ของแต่ละฝ่ายเกี่ยวกับการจัดการทรัพย์สินระหว่างสมรส

The Prospective Husband and the Prospective Wife intend to enter into marriage under the laws of the Kingdom of Thailand and agree to define their respective rights and obligations concerning the management of property during the marriage.

(ข) การเปิดเผยทรัพย์สินและหนี้สิน / Disclosure of Assets and Liabilities

• Both parties have made a full and complete disclosure to each other of their respective assets and liabilities (Exhibits C and D).

• Both parties have provided general disclosure only, without listing all individual details.

(ค) การบังคับใช้สัญญา / Applicability of Agreement

คู่สัญญาตกลงให้การจัดการสินส่วนตัวและสินสมรสอยู่ภายใต้บังคับของสัญญาก่อนสมรสฉบับนี้

The parties agree that the management of personal and marital property shall be governed by this Prenuptial Agreement.

(ง) สถานภาพและบุตร / Marital Status and Children

บัดนี้ คู่สัญญาทั้งสองฝ่ายจึงได้ตกลงกันดังต่อไปนี้:

NOW, THEREFORE, the parties agree as follows:

ข้อ ๑ สินส่วนตัว / Personal Property (Sin Suan Tua)

เพื่อประโยชน์แห่งสัญญานี้ “สินส่วนตัว” หมายถึง ทรัพย์สินของคู่สมรสที่กฎหมายไทยกำหนดให้เป็นสินส่วนตัวตามประมวลกฎหมายแพ่งและพาณิชย์ (รวมทั้งที่อาจมีการแก้ไขเพิ่มเติมในภายหลัง) ซึ่งรวมถึงแต่ไม่จำกัดเพียงดังต่อไปนี้

For the purposes of this Agreement, “Personal Property” (Sin Suan Tua) means property classified as the personal property of a spouse under the laws of the Kingdom of Thailand, as set out in the Thai Civil and Commercial Code (as may be amended from time to time), including but not limited to:

• (ก) ทรัพย์สินที่แต่ละฝ่ายมีอยู่ก่อนสมรส
• (a) property owned by either Party before the marriage;
• (ข) ทรัพย์สินที่ได้มาระหว่างสมรสโดยการรับมรดก หรือโดยการให้โดยเสน่หา
• (b) property acquired during the marriage by inheritance or by way of gift;
• (ค) ทรัพย์สินที่เป็นเครื่องใช้ส่วนตัว เครื่องแต่งกาย หรือเครื่องประดับที่เหมาะสมกับฐานะ หรือเครื่องมือที่จำเป็นต่อการประกอบอาชีพหรือวิชาชีพของแต่ละฝ่าย
• (c) items for personal use, clothing or ornaments suitable to the status of each Party, or tools necessary for their occupation;
• (ง) ทรัพย์สินที่ฝ่ายชายมอบให้ฝ่ายหญิงเป็นของหมั้น (ถ้ามี)
• (d) property given by the Prospective Husband to the Prospective Wife as engagement property (if any);
• (จ) ทรัพย์สินตามที่ระบุไว้ในเอกสารแนบท้าย หมายเลข ค และ ง
• (e) property listed in Exhibits C and D; and
• (ฉ) ทรัพย์สินหรือเงินที่ได้มาแทนทรัพย์สินตาม (ก)–(จ) ข้างต้น ให้ถือเป็นสินส่วนตัวของฝ่ายนั้นด้วย
• (f) any property or money acquired in substitution for, or as compensation for the loss, damage, disposal or conversion of, the property referred to above.
