BY AND BETWEEN

Mr. [Enter Full Name of Prospective Husband], residing at [Enter Address of Prospective Husband], hereinafter referred to as the “Prospective Husband”, details of whom are as set out in the copy of his passport attached hereto as Exhibit A;

and

Ms. [Enter Full Name of Prospective Wife], residing at [Enter Address of Prospective Wife], hereinafter referred to as the “Prospective Wife”, details of whom are as set out in the copies of her Thai national identification card and house registration attached hereto as Exhibit B.

Recitals

(A) Marriage Intention

The Prospective Husband and the Prospective Wife intend to enter into marriage under the laws of the Kingdom of Thailand and agree to define their respective rights and obligations concerning the management of property during the marriage.

(B) Disclosure of Assets and Liabilities

• ☐ Both parties have made a full and complete disclosure to each other of their respective assets and liabilities (Exhibits C and D).
• ☐ Both parties have provided general disclosure only, without listing all individual details.
• ☐ Both parties confirm that they have no material or significant debts as of the date of this Agreement.

(C) Applicability of Agreement

The parties agree that the management of personal and marital property shall be governed by this Prenuptial Agreement.

NOW, THEREFORE, the parties agree as follows:

Clause 1: Personal Property (Sin Suan Tua)

For the purposes of this Agreement, “Personal Property” (Sin Suan Tua) means property classified as the personal property of a spouse under the laws of the Kingdom of Thailand, as set out in the Thai Civil and Commercial Code (as may be amended from time to time), including but not limited to:

• (a) property owned by either Party before the marriage;
• (b) property acquired during the marriage by inheritance or by way of gift;
• (c) items for personal use, clothing or ornaments suitable to the status of each Party, or tools necessary for their occupation;
• (d) property given by the Prospective Husband to the Prospective Wife as engagement property (if any);
• (e) property listed in Exhibits C and D; and
• (f) any property or money acquired in substitution for, or as compensation for the loss, damage, disposal or conversion of, the property referred to above.
