Prenuptial Agreement (Preview)

BY AND BETWEEN

Mr. [Enter Full Name of Prospective Husband], residing at [Enter Address of Prospective Husband], hereinafter referred to as the “Prospective Husband”, details of whom are as set out in the copy of his passport attached hereto as Exhibit A;

and

Ms. [Enter Full Name of Prospective Wife], residing at [Enter Address of Prospective Wife], hereinafter referred to as the “Prospective Wife”, details of whom are as set out in the copies of her Thai national identification card and house registration attached hereto as Exhibit B.

Recitals

(A) Marriage Intention

The parties intend to marry under the laws of the Kingdom of Thailand and wish to record certain agreements and understandings concerning their respective personal and marital property.

(B) Disclosure of Assets and Liabilities

The parties acknowledge that they have disclosed to each other, to their satisfaction, the general nature and extent of their respective assets and liabilities, including the assets listed in the attached Exhibits.

(C) Applicability of Agreement

The parties agree that the management and classification of personal and marital property between them shall be governed by this Prenuptial Agreement to the extent permitted under Thai law.

(D) Family Status and Existing Obligations

Each party confirms that they have disclosed to the other party any children from previous relationships or marriages, as well as any material financial obligations, support obligations, maintenance obligations, or significant family responsibilities known to them at the time of entering into this Agreement.

Each party further confirms that they have had the opportunity to make reasonable inquiries concerning the personal and financial background of the other party before entering into this Agreement and the marriage.

(E) Scope of Agreement

This Agreement is intended primarily to apply to legal relations and assets connected with the Kingdom of Thailand and may operate together with separate agreements or legal arrangements in foreign jurisdictions where applicable.

NOW, THEREFORE, the parties agree as follows:

Clause 1 – Personal Property of the Parties

1.1 Definition of Personal Property

For the purposes of this Agreement, “Personal Property” (สินส่วนตัว) shall have the meaning given under Section 1471 of the Thai Civil and Commercial Code, including the assets listed in the attached Exhibits.

1.2 Personal Property of the Husband

The Husband’s Personal Property includes property owned before marriage, inheritance, gifts, personal items, professional tools, and any property otherwise classified as personal property under Thai law, including the assets listed in Exhibit C.

1.3 Personal Property of the Wife

The Wife’s Personal Property includes property owned before marriage, inheritance, gifts, personal items, engagement property (if any), professional tools, and any property otherwise classified as personal property under Thai law, including the assets listed in Exhibit D.

1.4 Increase in Value and Income from Personal Property

Any increase in value or appreciation of the Personal Property of either party shall remain the Personal Property of that party as between the parties, unless otherwise agreed in writing. Income or fruits derived from property shall be classified in accordance with applicable Thai law.
