ในสัญญานี้ เจ้าของและผู้ทรงสิทธิเก็บกินจะเรียกรวมกันว่า “คู่สัญญา”

In this Agreement, the Owner and the Usufructuary are collectively referred to as the “Parties”.

โดยที่ / WHEREAS:

(ก) เจ้าของเป็นเจ้าของกรรมสิทธิ์โดยชอบด้วยกฎหมายในที่ดินตามโฉนดที่ดินเลขที่ [ ] เล่ม [ ] หน้า [ ] เลขที่ดิน [ ] หน้าสำรวจ [ ] ตั้งอยู่ที่ตำบล [ ] อำเภอ [ ] จังหวัด [ ] เนื้อที่โดยประมาณ [ ] ไร่ ([ ] ตารางเมตร) ซึ่งต่อไปในสัญญานี้จะเรียกว่า “ที่ดิน”

(A) The Owner is the lawful owner of the plot of land identified by Land Title Deed No. [ ], Book No. [ ], Page [ ], Land No. [ ], Survey Page [ ], located at [ ] Sub-district, [ ] District, [ ] Province, with a total area of approximately [ ] Rai ([ ] square metres), hereinafter referred to as the “Land”. Details are as shown in the certified copy of the land title deed attached hereto as Attachment 3, which shall form an integral part of this Agreement.

(ข) เจ้าของประสงค์จะก่อตั้งสิทธิเก็บกินในที่ดินให้แก่ผู้ทรงสิทธิเก็บกิน โดยผู้ทรงสิทธิเก็บกินมีสิทธิครอบครอง ใช้ประโยชน์ ถือเอาซึ่งประโยชน์ตอบแทน และมีอำนาจจัดการที่ดินเท่าที่กฎหมายไทยอนุญาต

(B) The Owner wishes to grant the Usufructuary the right of usufruct over the Land, whereby the Usufructuary shall have the rights of possession, use, enjoyment and the sole right of management of the Land, to the extent permissible under Thai law.

ดังนั้น คู่สัญญาจึงได้ตกลงทำสัญญากัน โดยมีข้อความดังต่อไปนี้

NOW, THEREFORE, the Parties hereby agree as follows:

๑. สิทธิเก็บกิน / USUFRUCT RIGHTS

เจ้าของตกลงก่อตั้งสิทธิเก็บกินในที่ดินให้แก่ผู้ทรงสิทธิเก็บกิน และผู้ทรงสิทธิเก็บกินตกลงรับสิทธิเก็บกินในที่ดินจากเจ้าของ โดยภายใต้อำนาจของสิทธิเก็บกิน ผู้ทรงสิทธิเก็บกินย่อมมีสิทธิครอบครอง ใช้ประโยชน์ ถือเอาซึ่งประโยชน์ตอบแทน และมีอำนาจจัดการที่ดินเท่าที่กฎหมายไทยอนุญาต

The Owner agrees to grant to the Usufructuary, and the Usufructuary agrees to take from the Owner, the right of usufruct over the Land. By virtue of the usufruct, the Usufructuary shall have the rights of possession, use, enjoyment and the sole right of management of the Land, to the extent permissible under Thai law.

๒. ระยะเวลาแห่งสิทธิเก็บกิน / TERM OF USUFRUCT

๓. การระงับสิทธิเก็บกิน / EXTINCTION OF USUFRUCT

ในกรณีที่ผู้ทรงสิทธิเก็บกินถึงแก่ความตาย สิทธิเก็บกินตามสัญญาฉบับนี้ย่อมระงับสิ้นไปโดยผลแห่งกฎหมาย และเมื่อสิทธิเก็บกินดังกล่าวระงับสิ้นไป ให้ที่ดินตกกลับคืนแก่เจ้าของโดยปราศจากภาระผูกพันหรือหนี้สินใด ๆ อันได้จดทะเบียนบังคับแก่ที่ดินโดยอาศัยสิทธิเก็บกินตามสัญญาฉบับนี้

In the event of the death of the Usufructuary, the usufruct under this Agreement shall be extinguished by operation of law. Upon such extinction, the Land shall revert to the Owner free from any encumbrances or liabilities registered against the Land by virtue of this usufruct.
