A building permit (the official permission to built or alter a structure on a piece of land with a land title deed) is issued by the local 'Or Bor Tor'. The construction plans must comply with the Building Control Act and the Town and City Planning Act and local specifications issued under these acts. The relation between a employer and the contractor in Thailand is governed by the construction agreement with attachments, the civil and commercial code and specifically the sections 587 to 607". House Construction Agreement
THIS AGREEMENTis made on ______ day of _____, 2023.
BETWEEN
1. Mr./ Ms./ Mrs. _____________, residing at _________________________, (hereinafter referred to as the 'Customer') of the one part; and

This contract is between the customer and contractor only. A third party consultant or architect has not been appointed.
WHEREAS
(a) The Customer is the ____insert owner/ lessee____ of the land with title deed number ____, land number ____, located at ________ (hereinafter referred to as 'the Site')
(b) The Customer wishes to employ the Contractor for the construction of a _ storey and _ bedroom house on the Site having a total floor area of approximately ___ square meters as described in the construction drawings attached hereto as Annex I, hereinafter referred to as 'the Work'. NOW IT IS HEREBY AGREED as follows::
1. PLANNING PERMISSION AND BUILDING REGULATIONS
The Contractor will apply for any planning permission and building regulations approval or awards that may be needed. The Contractor will not start Work at the Site before any planning permission or awards that are needed have been received. However, the Contractor can start Work before building regulations approval is received but he must to let the local authority know at least 48 hours before he starts.
2. THE PRICE.
2.1 The price for the Work is fixed at _________ (___ Hundred _____Thousand) Thai baht (including any VAT), hereinafter referred to as 'the Price'
2.2. In the Price is included the Contractor's costs for applying for planning permission and building regulations approval or awards.
2.3 All materials, equipment and accessories required in the Work shall be procured by the Contractor in accordance with the quantity and quality described in the plans specifications attached to this agreement
2.4 The Price also includes the Contractor's costs of dealing with any unexpected problems which he could have discovered by carrying out a careful inspection before the price was agreed.

(ค) ผู้รับจ้างตกลงจะเริ่มดำเนินการ งานที่จ้าง ไม่ช้ากว่า วันที่ ______ เดือน________พ.ศ และจะดำเนินงานที่จ้างที่จ้าง ให้เสร็จสิ้นภายใน วันที่______ เดือน_______ พ.ศ ________ต่อไปในสัญญานี้เรียกว่า “วันส่งมอบงาน” โดย งานที่จ้าง จะถือว่าแล้วเสร็จ ต่อเมื่อผู้รับจ้างได้ดำเนินการ งานที่จ้าง เรียบร้อยครบถ้วนทุกประการตามที่กำหนดไว้ในสัญญานี้หรือตามที่จะได้มีการตกลงแก้ไขเปลี่ยนแปลงกัน
ดังนั้นคู่สัญญาจึงได้ตกลงกัน โดยมีข้อตกลง ดังต่อไปนี้
๑. แบบขออนุญาตก่อสร้างและใบอนุญาตก่อสร้างอาคาร
ผู้รับจ้างจะต้องยื่นแบบขออนุญาตก่อสร้างและขอรับใบอนุญาตก่อสร้างอาคารตามความจำเป็น ผู้รับจ้างตกลงจะไม่เริ่มดำเนินการ งานที่จ้าง ในสถานที่ก่อสร้างก่อนที่จะได้รับอนุมัติแบบขออนุญาตก่อสร้างและได้รับใบอนุญาตก่อสร้างอาคารเป็นที่เรียบร้อยแล้ว แต่อย่างไรก็ตาม ผู้รับจ้างอาจเริ่มงานที่จ้างก่อนได้รับใบอนุญาตก่อสร้างอาคารแต่จะต้องแจ้งให้เจ้าพนักงานท้องถิ่นทราบอย่างน้อย 48 ชั่วโมงก่อนเริ่มดำเนินงานที่จ้างที่จ้าง
๒. ค่าจ้าง
๒.๑ ราคาค่าจ้างสำหรับ งานที่จ้าง ผู้ว่าจ้าง และ ผู้รับจ้าง ตกลงกันเป็นเงินทั้งหมดจำนวน __________ บาท ________สตางค์ ถ้วน (รวมภาษีมูลค่าเพิ่ม) ต่อไปในสัญญานี้เรียกว่า “ราคาค่าจ้าง”
๒.๒ ราคาค่าจ้างในข้อที่ 2.1 รวมค่าใช้จ่ายของผู้รับจ้างในการจัดเตรียมและดำเนิ นการยื่นแบบขออนุญาตก่อสร้างและขอรับใบอนุญาตก่อสร้างอาคารแล้ว
๒.๓ ผู้รับจ้างจะต้องจัดหาบรรดาสัมภาระ อุปกรณ์และเครื่องมือเครื่องใช้ทั้งหมดที่ต้องใช้ในการงาน ทั้งนี้ตามคุณภาพและปริมาณตามที่กำหนดไว้ใน แบบและรายการก่อสร้าง เอกสารแนบท้ายสัญญานี้
๒.๔ ค่าจ้าง ให้รวมค่าใช้จ่ายของผู้รับจ้างสำหรับการติดต่อประสานเกี่ยวกับปัญหาต่างๆที่อาจเกิดขึ้น ซึ่งผู้รับจ้างสามารถรู้ได้โดยหากได้พิจารณาตรวจสอบโดยถี่ถ้วนก่อนคู่สัญญาจะได้มีการตกลงราคาค่าจ้างกัน
